By creating an account on WFDF Academy, you agree that you will:

• Read, understand and comply with WFDF Bylaws, Policies, Procedures, Codes of Conduct and associated Rules.
• Complete all activities, quizzes and assignments on your own, unless collaboration is explicitly permitted.
• Complete all activities to your full ability and following course expectations.
• Complete all activities with honesty and academic integrity.
• Maintain only one user account and do not let anyone else use your username and/or password.
• Not engage in any activity that would dishonestly improve your results or improve or hurt the results of others.

Please note that WFDF will review and may make changes to the Site Policy from time to time. Any changes to the terms of use will be effective immediately upon posting on this page. By accessing WFDF Academy after any changes have been made, you signify your agreement on a prospective basis to the modified terms of use and any changes contained therein. Be sure to return to this page periodically to ensure familiarity with the most current version of the Site Policy.

Rules for Online Conduct

On WFDF Academy, participants/users are expected to act responsibly and to show respect and consideration to other users.

You agree that you are responsible for your own use of WFDF Academy and for your user postings. "User Postings" include all content submitted, posted, published or distributed on the site by you or other users of the site, including but not limited to all forum posts, wiki edits, notes, questions, comments, videos and file uploads. You agree that you will use the site in compliance with these terms of use and all applicable local, state, national and international laws, rules and regulations, including copyright laws and any laws regarding the transmission of technical data exported from your country of residence.

The following are strictly prohibited on WFDF Academy:

• Content that defames, harasses or threatens others;
• Content that discusses illegal activities with the intent to commit them;
• Content that infringes another's intellectual property, including, but not limited to, copyrights or trademarks;
• Profane, pornographic, obscene, indecent or unlawful content;
• Advertising or any form of commercial solicitation;
• Content related to partisan political activities;
• Viruses, Trojan horses, corrupted files, malware, spyware or any other similar software that may damage the operation of another's computer or property;
• Content that contains intentionally inaccurate information or that is posted with the intent of misleading others;
• Use of the site in any manner intended to damage, disable, overburden or impair any site server or the network(s) connected to the site or to interfere with any other party's use of the site;
• Attempts to gain unauthorized access to the site, other accounts, computer systems or networks through any means;
• Attempts to obtain any materials or information stored on the site, its servers or associated computers through any means not intentionally made available through the site; and
• Misrepresenting or attempting to misrepresent your identity while using the site.

WFDF will endeavor to remove any content that is deemed inappropriate. Spammers or anyone else who persists in violating our code of conduct will have their account blocked and deleted.

Rules for Registration

By registering for WFDF Academy, you:

• Consent to the free use of your name, image, voice, likeness and provided information by WFDF and its partner organizations for operational, editorial and promotional use (e.g., certification course recordings, in broadcast, telecast, commercial recording and advertising).
• Consent to the use of your personal data (name, email address and any other optional information you choose to provide) for registration and purposes of instruction and organizing the course(s) and site.
• Related to participation in an in-person activity or course, agree that you are risking serious injury, including chronic pain, permanent incapacitation, paralysis and death, particularly through contact with objects such as flying discs or other participants on or outside the field of play and/or courses. You acknowledge that there have historically been deaths associated with participating in similar activities due to lightning strikes, heart attacks, and/or accidents. You take responsibility to ensure that participant safety is maintained at all times and that problems are addressed or reported as they occur. You will discontinue participation in an activity if you are affected by heat, feel dizzy, nauseous, or weak, and will seek medical attention immediately. You are responsible for ensuring that any property brought is protected from loss, theft or damage.
• Understand and agree that your personal data is being stored and used by WFDF, partner organizations and course organizers. Further, if necessary, it may also include the responsible host government, law enforcement, border services and security agencies and similar organizations authorized by WFDF, and may include organizations located in countries outside of the European Union not recognized by the European Commission as offering an adequate level of data protection for the purposes of, and to the extent necessary in relation to, facilitating my participation in and organizing courses. When data is hosted and processed using services provisioned by providers based in the United States, the data may be processed by the authorities in the United States for control and monitoring purposes without any right of appeal.
• Understand that you have a right to access and correct or erase the personal data or restrict or object to the processing of such personal data that WFDF holds about you per your rights under data protection laws by contacting WFDF.
• Understand that all course material is the property of WFDF and referenced partners and is only accessible to the course participants. Sharing course content in any form (including but not limited to screenshots, video recordings or live feeds) with a third party without the prior written permission of WFDF is strictly prohibited.
• Agree that you must meet the applicable prerequisites and course conditions (such as payment of registration fees). Participant registration fees cover the cost of the program and are non-refundable, inclusive of applicable taxes in the territory. If a participant fails or does not complete the course, the fee is not refunded.
• Understand that WFDF and its partner organization(s) reserve the right to cancel courses for various reasons without prior notice. WFDF and its partner organization(s) are not responsible for any arrangement you made to attend the course.

Violations and Termination

If you are found in violation of the Site Policy, you may be subject to one or more of the following actions:

• Receiving a zero or no credit for an assignment, quiz or activity;
• Having any certificate or badges earned withheld or revoked;
• Notification to partner organization(s);
• Being unenrolled from a course; or
• Termination of your use of WFDF Academy.

Additional actions may be taken at the sole discretion of the WFDF and partner organizations.

Site Policy violations will be determined at the sole discretion of WFDF. You will be notified if a determination has been made that you have violated these terms of use and you will be informed in writing of the corresponding action to be taken as a result of the violation.

You may terminate your use of the Services at any time, either by ceasing to access them or by deleting your account. WFDF has no obligation to retain any of your account, course data, certificates, or submitted content for any period of time.

Limits of Service

No guarantee or warranty is expressed or implied. WFDF Academy and its content are not permanent. The site may be closed at any point and any data that you uploaded will be deleted at our discretion. We cannot be held liable for any perceived loss of data or service.

Indemnification

You agree to defend, indemnify and hold harmless the WFDF, its subsidiaries, affiliates, licensors, employees, agents, third-party information providers, and independent contractors against any claims, damages, costs, liabilities and expenses (including, but not limited to, reasonable attorneys’ fees) arising out of or related to your conduct, your use or inability to use the site, your breach or alleged breach of the site terms or of any representation or warranty contained herein, your unauthorized use of the WFDF content, or your violation of any rights of another.

Disclaimer

This site and the WFDF content are provided “as is,” and the WFDF and its directors, employees, content providers, agents, contractors, and affiliates exclude, to the fullest extent permitted by applicable law, any warranty, express or implied, including, without limitation, any implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. WFDF will not be liable for any damages of any kind arising from the use of this site or the content, badges, and/or certificates, or the unavailability of the same, including, but not limited to, lost profits and direct, indirect, incidental, punitive and consequential damages. The functions embodied on or in the materials of this site are not warranted to be uninterrupted or without error. You, not the WFDF, assume the entire cost of all necessary servicing, repair or correction due to your use of this site or the WFDF content. We make no warranty that the site or the WFDF content is free from infection by viruses or anything else that has contaminating or destructive properties.

The WFDF uses reasonable efforts to ensure the accuracy, correctness and reliability of the WFDF content, but we make no representations or warranties as to the content’s accuracy, correctness or reliability.

Limitation of Liability

In no event shall the WFDF, its directors, members, employees, contractors, or agents be liable for any direct, special, indirect or consequential damages, or any other damages of any kind, including but not limited to loss of use, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the use of the site, the services, the WFDF content or the materials contained in or accessed through the site, including without limitation any damages caused by or resulting from reliance by a user on any information obtained from the WFDF, or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of god, communications failure, theft, destruction or unauthorized access to the WFDF’s records, programs or services. In no event shall the aggregate liability of the WFDF, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use of the site, exceed any compensation you pay, if any, to the WFDF for access to or use of the site.

You knowingly and freely assume all risks, both known and unknown, for yourself and on behalf of your heirs, assigns, personal representatives and next of kin for participation in activities, courses and events associated with WFDF. You hereby release and agree to hold harmless WFDF, the local organizing committee, their staff, officers, directors, contractors, officials, sponsors, advertisers, affiliated clubs, their respective administrators, directors, agents, coaches, and other employees of the organization, other participants, and, if applicable owners and lessees of premises used to conduct the activities, courses and events, all of which are hereinafter referred to as “releasees.” Even if arising from the negligence of the releasees or others, you assume full responsibility for participation and with respect to all and any injury, disability, death or loss or damage to person or property, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law, you will indemnify, save and hold harmless the above-named releasees of, from and against any loss, cost, expense, damage or liability that such releasees may incur as a result of, arising from or in connection with such claims, including without limitation attorney’s fees and other costs or expenses of litigation.
